This line from RFC 1123 seems to contradict you:

            Specifically, a DNS resolver or server that is sending a
            non-zone-transfer query MUST send a UDP query first.

This isn't specifically a "DNS RFC", so maybe you aren't technically 
wrong.  But RFCs 1122 and 1123 are effectively part of every prior RFC 
that they update.
