CNAME Misconfiguration? Discrepancy between Bind 8.2.3 and Bind8.2.2?

Do I have to downgrade a server to prove it?  

I'm running DNS for 25,000 domains.  Some users (a few) had CNAME's at the zone-top.  An error was output in the load log - and we chastised the users for having them - but they were "supported".
