If you keep them both running, you will indeed run into trouble,  
whether they are connected to the same switch or not.

In the United States, different ISPs do different things, but while my  
ISP does ship you a modem, they don't really care if you use your own,  
and more to the point, they most certainly do not check to see that  
you are using theirs during the DHCP handshake.   Think about how much  
unnecessary work this would be!
