In germany we do have smaller ISPs and many of them dont even know they are.
Nevertheless - legally they are.

In germany apartement complexes with common internet access are ISPs
concerning childporn or copyright bombs. DNS is such a concern.
The local city government might ask you to censor or to turn over your logs.
You have to keep the logs for half a year...
